if the Colonial Court empowered one such Case to grant special leave to Appeal subject to confirmation by the Judicial Committee, there would not be much ground to foresee any inconvenience in the Exercise of such Power, while a great saving would be effected by reason of the Record being transmitted at once.
I did not wish to convey the impression that such Power could in my Opinion be conferred by a Colonial Ordinance but always contemplated that the suggestion would be approved of and carried out by Counsel, Additional Order.
If however it should not be deemed expedient to confer such Power on the Colonial Court, I apprehend there would be an objection to an Ordinance empowering the Court in the particular Class of Cases referred to, in such terms as to be just in Operation for such Cases and upon appeal.
To suspend the final Judgment for a limited Period would allow of Application to the Privy Council for Special leave to appeal.
